TERMS, CONDITIONS AND POLICIES

These terms and condition does not affect your statutory right as consumers. Content on this page is for your general information and is subject to change. All Products made by The Teaspoon Auckland are subject to the following Terms and Conditions:

OUR PRODUCT

Products made by The Teaspoon Auckland are made by hand and accordingly, there will be minor variations in appearance. All photos, illustrations and descriptions displayed on our website and other social media are for guidance purpose only.

 

INGREDIENTS & SENSITIVITY TO INGREDIENTS DISCLAIMER

The Teaspoon Auckland Cakes are NOT a allergen-free cakery. It is the responsibility of the CLIENTS to inform us prior to the confirmation of their booking, of any allergy / intolerance issues.  It is the responsibility of the CLIENTS to inform their guests of all allergy / intolerance information. The Teaspoon Auckland will not be held liable for any allergic reaction resulting from consumption of the cake. All products are made to be eaten on the day of the celebration and are best eaten at room temperature.  Because our cakes and buttercream are made with fresh butter, it may take 2-3 hours for your cake to come to room temperature. Please plan delivery time and cake storage accordingly.

FRESH FLOWERS: Flowers are handled in accordance to food safety (washed and wrapped in floral tape). The CLIENT acknowledge that fresh flowers are not food product and may contain pesticides, insects, dirt or other contaminant.

ALLERGENS: All cakes, fillings and icings may contain, or come into contact with, soy, wheat, dairy, nuts, wheat,gluten and other allergens.

NON-EDIBLE ITEMS: Most cakes contains small proportions of inedible items this includes and not limited to dowels and sticks, picks, ribbons wires and flower tapes.

CAKE QUOTES

All Quotes are valid for 30 days from the date of issue.  In the event that the desired date has been filled by another order / CLIENT, prior to the CLIENT confirming the booking by paying the 50% deposit, The Teaspoon Auckland is not obliged to honour the quote.  

**All Quotes are NOT bookings and are subject to availability. 

CAKE ORDERS AND DESIGN

The Teaspoon Auckland prefer at least two to three (2-3) weeks notice for all orders, as we are continually booked in advance.  We will however, where availability permits, accept short notice orders. Our products are handmade so no two cakes are the same. Any product ordered from a photo of a product produced by any other cake maker, can only be reproduced by The Teaspoon Auckland’s own interpretation of that product and will not be an exact reproduction of the product in the photo.  Certain creative changes may be made to your final design for the sake of stability and structural integrity.

Changes to the order may be made 1 week prior to event. After this time any change requests cannot be guaranteed and may be subject to additional charges as we order our ingredients in advance. 

CAKE SERVING SIZES

Cake serving sizes are estimated. Specialty cakes and method of slicing may affect ultimate serving number.  The CLIENT understands and accepts these terms, and must order their products accordingly after having considered these variables.

DEPOSITS & FINAL PAYMENTS POLICY

A NON-REFUNDABLE, NON-TRANSFERABLE deposit of 30% is required to hold your date. Apart from administration cost, this is because we make/purchase some parts of your cake in advance (cake toppers, special ingredients etc.) and our booking calendar fills up quickly, this means if you make a cancellation, the slot reserved to your cake could have been allotted to other people’s cake so we lose two orders. Your order is not confirmed until the deposit is paid. If an order is placed within the seven (7) days prior to pick up, 50% of total payment is required upon placing the order.

For celebration cakes, the balance is due on or before the event date.  For wedding cakes and large event cakes the balance is due one week prior to the wedding or event.

CHANGE OF DATES    

If, for any reason the event is required to be postponed, please contact us immediately.  The new date proposed will be subject to availability.

UNFORESEEN CIRCUMSTANCES

We are living in a very unique times, if The Teaspoon Auckland cancels the booking due to illness or any other unforeseen circumstance that affects the ability to deliver the ordered Product, the deposit will be refunded within seven (7) days of notification to the CLIENT.  We will not cancel or reschedule your order unless there are extenuating circumstances. We will endeavour to provide notice as far in advance as possible. 

DELIVERY POLICY

The Teaspoon Auckland does deliveries for a fee and is subject to agreement between us and the CLIENT. Delivery will be carried out in a safe and appropriate manner. Once delivered to the CLIENT and change of hands has been completed with the product in appropriate condition, it is then up to the CLIENT to store and care for the cake as per The Teaspoon Auckland instructions. If anything is to happen to the cake after this exchange, and deemed to be fault of the CLIENT through not following the instructions provided, The Teaspoon Auckland is not liable for any damages.  The Teaspoon Auckland is not liable for damage due to CLIENT negligence or improper handling once the product has been picked up or delivered.

A delivery date and time will be agreed by both parties, and if the CLIENT is not at location at this time and date, and The Teaspoon Auckland is not able to contact the CLIENT, the product will be transported back with The Teaspoon Auckland and it will be the CLIENT’s responsibility to collect the product at a time that suits The Teaspoon Auckland and cannot guarantee freshness of product. 

DAMAGES   

It is the responsibility of the CLIENT to check the state of the product before making final payment upon delivery/pickup. Once the item has been delivered/picked up, the CLIENT has accepted the item as is, and is responsible to ensure that the products gets to its destination safely and/or is stored as per instructions from The Teaspoon Auckland to achieve best results for taste and quality and to avoid any damage.

TRAVELLING WITH THE CAKE AND THIRD PARTY PICKUP    

DO NOT place cake in the car seat as they are slanted and can damage the cake. Cake should be placed on the boot of the car or foot well on a non slip mat. Extra care should be taken when driving as some parts of the cake may be delicate. If a third party will be collecting the cake on the CLIENT’s behalf or taking responsibility for the cake when delivered, this party will be given all appropriate information that would have been given to the CLIENT. Same conditions apply as if the CLIENT were to collect the cake themselves.  The Teaspoon Auckland is not liable for damage due to third party negligence or improper handling once the product has been picked up or delivered.

SOCIAL MEDIA

The Teaspoon Auckland reserves the right to use any image of a Product made by us for publication immediately or at a later date.  The Teaspoon Auckland will not post any photos on social media or other platforms until after your event has taken place. The Teaspoon Auckland will never use any image that is supplied by the CLIENT, without first obtaining the CLIENT’s permission.

EQUIPMENT RENTAL

Deposits are taken for all rented equipment. All equipment must be returned on the agreed date or extra charges will be incurred to cover any additional costs. Any damages to equipment will forfeit or reduce your deposit to cover costs of repair or replacement.  Equipment rental price, deposit and all other charges will vary depending on which item of equipment is being hired, and in what condition and time frame it is returned by the CLIENT.

CANCELLATIONS AND REFUNDS    

If cancellation of the order is required, and you have paid your full balance, the refund policy is as follows:     a) If the cancellation is up to one (1) month in advance of your event date, you will receive a refund, less your initial deposit and the cost of any supplies already purchased for your cake. Refunds will be paid within 30 days of cancellation.  b) If the cancellation is less than seven (7) days prior to your event, there will be no refund given.  c) There will be no refund given for no shows. d) Delivery times are pre-arranged, if you are late and don’t contact us, refund will not be issued. 

 

Where The Teaspoon Auckland has delivered a product that is an accurate interpretation of what has been quoted and invoiced, but the CLIENT does not accept the finished Product, the deposit WILL NOT be refunded. The CLIENT can choose to pay the remainder and take the product/s, or leave them at no extra cost.

**ALSO NOTE: By paying the NON-REFUNDABLE retainer, you are accepting and agreeing to the terms and conditions set forth in this agreement.
